Springfield shooting victim held without bail for dangerousness hearing

The new case comes 12 months after Garcia-Cappas was charged with possession of heroin with intent to distribute after police raided an apartment in North Adams.

SPRINGFIELD -- A man who was shot during an armed confrontation outside a Springfield home Wednesday is being held without right to bail for a detention hearing next week.

Emilio Garcia-Cappas, 21, of Holyoke, pleaded not guilty Thursday in Springfield District Court to five charges, including carrying a loaded firearm without a license and possession of a large capacity firearm in commission of a felony.

At the request of Assistant District Attorney Cary Szafranski, the defendant was ordered held for a so-called dangerousness hearing on Tuesday.

Garcia-Cappas allegedly showed up on the porch of an Edgewood Street home Wednesday afternoon and pointed a gun at the homeowner, according to Ryan Walsh, police spokesman.

The homeowner responded by drawing his own gun and shooting Garcia-Cappas, who fled and later showed up for treatment at Mercy Medical Center. He was arrested after being transferred to Baystate Medical Center, where he was treated for non-life threatening injuries, Walsh said.

The shooting remains under investigation, according to Walsh, who said three weapons have been recovered by police.

No additional details, including a possible motive for the confrontation, were provided during Garcia-Cappas's brief appearance in court. At the detention hearing next week, prosecutors will argue that Garcia-Cappas poses too great of a risk to the alleged victim or the public to be released on bail.

The new case comes 12 months after Garcia-Cappas and two others were arrested on drug offenses after police raided an apartment in North Adams. Garcia-Cappas was charged with possession of heroin with intent to distribute, conspiracy to violate drug laws and giving a false name to a police officer.

The raid was conducted by the Berkshire County Drug Force and the Massachusetts State Police Special Tactical Operations (STOP) Team following an investigation into drug activity there.

In April, Garcia-Cappas pleaded guilty to the charges. Sentencing information was not available Thursday.
