Springfield police investigating daytime assault in Forest Park; victim claims 2 teens robbed him

The teenage victim said two Hispanic teenagers assaulted him and took his book bag and other items.

SPRINGFIELD — Police were called to Forest Park for a Sunday morning report of an assault and robbery.

A 19-year-old victim told investigating officers he was assaulted in a wooded section of the park by two other teenagers who took his book bag and other items. No weapon was shown during the alleged incident.

An ambulance was dispatched to the area of the ranger station to assist the victim. The extent of his injuries was not immediately known.

Officers said they were checking the area for the suspects, who were described as two Hispanic teens last seen near the park's tennis courts. One was wearing a white T-shirt and cargo shorts, the other a black shirt and jeans.

Three Worcester teenagers shot early Sunday morning

Three teenagers were shot in early-morning incidents in Worcester Sunday. Police say in one incident there appeared to be an exchange of gunfire between two groups.

WORCESTER -- The Worcester Telegram & Gazette is reporting that three teenagers were shot in two separate incidents in the city early Sunday morning. 

None of the injuries were life threatening. 

According to a story by T&G reporter Scott J. Croteau, police believe the first shooting, which involved a 15-year-old male victim with a gunshot wound to the thigh, took place on Albert Street. The victim and the witnesses were uncooperative with police, the T&G reported. 

The second shooting was on Dorchester Street just before 3 a.m., the T&G reports. A 16-year-old and a 19-year-old male were found with gunshot wounds to the legs.

Both victims were taken to a local hospital with non life-threatening injuries. Police said evidence showed there might have been an exchange of gunfire between two groups on the street. There is no information about suspects.

Police have responded to at least three gunfire reports in Six Corners since Aug. 21, including an incident involving a man who was shot on Foster Street.

SPRINGFIELD — Police are investigating Sunday morning shooting reports in Six Corners and Indian Orchard that caused property damage but no apparent injuries.

Officers were called to Six Corners about 3:30 a.m. after the city's ShotSpotter system detected four gunshots in the area of 67 Dexter St. Details of the investigation were not immediately known, but a detective unit was called back to the scene around 11 a.m. Sunday to take photographs.

The Indian Orchard incident was reported around 4:55 a.m. on Montcalm Street, where a resident reportedly awoke to gunfire and found a bullet hole in a window. A car parked next door to the residence also was struck by gunfire, according to police reports.

Meanwhile, police have responded to multiple gunfire reports in Six Corners over the past 10 days, including this morning's incident.

On Aug. 21, officers responded to shots fired at three people on a George Street porch, none of whom were hit, and an Aug. 23 incident involving a victim who was shot in the foot.

George Street connects to Dexter Street, and Foster Street is just one block away, but police have not indicated if the incidents are connected.

House, Senate intel chiefs push Obama to be tougher on Islamic State militants

Sen. Dianne Feinstein, the California Democrat who leads the Senate intelligence panel, said Obama is perhaps "too cautious" in his approach to combatting the Islamic State group.

WASHINGTON (AP) -- Leaders of the House and Senate intelligence committees on Sunday prodded President Barack Obama to take decisive action against what they say are growing threats from Islamic State militants on U.S. soil.

The lawmakers, one Republican and one Democratic, offered bipartisan pressure on the White House to turn back the hazard of Islamist fighters who have taken control of vast swaths of Syria and Iraq. Those militants now are looking toward the United States or Western Europe for its next targets, lawmakers said.

Without offering specifics on any threats or suggestions how to confront them, the lawmakers said Obama soon needs to develop a comprehensive strategy to crush the fighters.

"His foreign policy is in absolute free-fall," said Rep. Mike Rogers, a Michigan Republican who heads the House Intelligence Committee.

In another TV interview, Sen. Dianne Feinstein, the California Democrat who leads the Senate intelligence panel, said Obama is perhaps "too cautious" in his approach to combatting the Islamic State group.

"This is a group of people who are extraordinarily dangerous," Feinstein said. "And they'll kill with abandon."

The pair of lawmakers, who have access to some of the nation's most sensitive secrets and receive regular and detailed briefings from the nation's spy agencies, offered dire predictions of an attack on the United States or its European allies if the militants are not confronted.

"They have announced that they don't intend to stop," Feinstein said. "They have announced that they will come after us if they can, that they will, quote, 'spill our blood.'"

The threat, Rogers said, could include Americans who have trained with Islamic State fighters. He said there are hundreds of Islamic State-trained Americans who can return to the U.S. with their American passports.

"I'm very concerned because we don't know every single person that has an American passport that has gone and trained and learned how to fight," Rogers said.

Rogers said U.S. intelligence agencies were tracking the Americans who are known to have traveled to the region. If they helped Islamic State fighters, he said, they should be charged under laws that prohibit Americans from aiding terrorists.

"ISIL would like to have a Western-style attack to continue this notion that they are the leading jihadist group in the world," Rogers said, using another name for the group.

The top Democrat on his intelligence panel, Rep. C.A. Dutch Ruppersberger of Maryland, was more skeptical. He said more needs to be known before judging whether they plan to commit terrorist acts in the U.S. any time soon. The group's priority now seems to be to hold on to territory it has gained rather than export violence.

"It is extremely urgent, but you don't just rush in," he said.

It was a view shared by Rep. Adam Smith, a Washington state Democrat on the House Armed Services Committee: "We can't simply bomb first and ask questions later."

Sen. John McCain, an Arizona Republican who serves on the Senate Foreign Relations Committee, urged fast action and said Islamic State fighters "must be defeated, not contained," because they represent a direct threat to the U.S.

Added Homeland Security Committee member Rep. Peter King, R-N.Y.: "The longer we wait, the more dangerous" the group becomes.

Feinstein said she has seen nothing that compares to the viciousness of the militants who have overrun large portions of Iraq, killed civilians and beheaded American journalist James Foley. The Islamic State group has financing, military structure and weapons unlike any other militants, she said.

Obama said Thursday he did not yet have a strategy for dealing with the Islamic State organization, a remark that brought criticism from Democrats and Republicans. In an interview published early this year by The New Yorker, the president appeared to minimize the group by comparing it to a junior varsity basketball team. The White House said he was speaking about a different threat posed by a range of extremists across the world.

Feinstein said she thought the basketball analogy was wrong -- "I think it's a major varsity team" -- but would not say whether she thought Obama projected weakness by admitting he had no strategy.

"I think I've learned one thing about this president, and that is he's very cautious," she said. "Maybe in this instance, too cautious. I do know that the military, I know that the State Department, I know that others have been putting plans together. And so hopefully, those plans will coalesce into a strategy."

Feinstein spoke to NBC's "Meet the Press." Rogers appeared on "Fox News Sunday." Ruppersberger was on CNN's "State of the Union." McCain, Smith and King were interviewed on CBS' "Face the Nation."

Islamist militia group says it 'secured' US compound in Libya

The Islamist militia's move likely will reinvigorate debate in the U.S. over its role in Libya, more than three years after supporting rebels who toppled dictator Moammar Gadhafi.

TRIPOLI, Libya (AP) -- The Islamist-allied militia group in control of Libya's capital has "secured" a U.S. Embassy residential compound there, more than a month after American personnel evacuated from the country over ongoing fighting, one of its commanders said Sunday.

The Islamist militia's move likely will reinvigorate debate in the U.S. over its role in Libya, more than three years after supporting rebels who toppled dictator Moammar Gadhafi. It also comes near the two-year anniversary of the slaying of U.S. Ambassador Chris Stevens and three other Americans in Libya's second-largest city of Benghazi.

An Associated Press journalist walked through the U.S. Embassy compound Sunday after the Dawn of Libya, an umbrella group for Islamist militias, invited onlookers inside. Some windows at the compound had been broken, but it appeared most of the equipment there remained untouched. The journalist saw treadmills, food, televisions and computers still inside.

A commander for the Dawn of Libya group, Moussa Abu-Zaqia, told the AP that his forces had entered and been in control of the compound since last week, a day after it has seized control of the capital and its international airport after weeks of fighting with a rival militia. Abu-Zaqia said the rival militia was in the compound before his troops took it over.

The Dawn of Libya militia is not associated with the extremist militia Ansar al-Shariah, which Washington blames for the deadly assault on the U.S. Consulate in Benghazi on Sept. 11, 2012, that killed Stevens and the three other Americans.

A video posted online Sunday showed unarmed men playing in a pool at the compound and jumping into it from a second-story balcony. Voices heard in the video identified it as the U.S. Embassy compound.

In a message on Twitter, U.S. Ambassador to Libya Deborah Jones said the video appeared to have been shot in at the embassy's residential annex, though she said she couldn't "say definitively" since she wasn't there.

"To my knowledge & per recent photos the US Embassy Tripoli chancery & compound is now being safeguarded and has not been ransacked," she wrote on Twitter. She did not immediately respond to a request to elaborate. State Department officials in Washington also declined to immediately comment.

On July 26, U.S. diplomats evacuated the compound and the capital to neighboring Tunisia under a U.S. military escort as fighting between rival militias intensified and thousands fled. The State Department said embassy operations would be suspended until the security situation improved.

Typically, local forces provide security for diplomatic posts, but Libya's government has largely relied on militias for law enforcement since Gadhafi's ouster, as its military and police forces remain weak. In the past several weeks, the security vacuum in Tripoli deepened as militia violence worsened. It remains unclear who the U.S. left in control of guarding its facilities after its personnel evacuated.

Libya's militias, many of which originate from rebel forces that fought Gadhafi, have become powerful players in post-war Libya. Successive governments have put militias on their payroll in return for maintaining order, but rivalries over control and resources have led to fierce fighting among them and posed a constant challenge to the central government and a hoped-for transition to democracy.

Following weeks of fighting that brought the capital to a standstill, the Dawn of Libya militia said last week it managed to seize control of Tripoli's airport and drive a rival militia from the mountain town of Zintan out of the capital. It is now deployed around the capital and has sought to restore normalcy in the city. The group called on foreign diplomats to return now that the fighting has subsided.

EASTHAMPTON — Easthampton residents are warned to remain vigilant after a report of an attempted daytime breaking and entering.

Saturday around 2:40 p.m., police responded to 139 Hendrick St. for a report of a breaking and entering in progress, said officer William Mielke. The residents were home at the time, he said. Nothing was taken, and no arrest has been made, said Mielke.

Mielke said residents should call police if they observe suspicious activity in their neighborhoods. The incident remains under investigation.

Wilbraham police invesgitating attempted burglary on Boston Road; suspect was 'spooked' by resident and fled on scooter

A resident of a Boston Road home reportedly "spooked" a would-be burglar, who fled the scene on a scooter-type vehicle with no lights. Anyone with information is asked to call the Wilbraham Police Department at (413) 596-3837.

WILBRAHAM — Authorities responded to an attempted break-in at a Boston Road home early Friday that was interrupted by a resident who "spooked" the would-be burglar, according to Wilbraham police, who continue to investigate.

Officer Brent Noyes, Sgt. Edward Lennon and Detective Jeffrey Rudinski responded to the area of 3000 Boston Road after receiving a report of someone trying to illegally enter the occupied home through a bedroom window.

"The suspect was spooked by an occupant of the residence and fled the scene," police said.

No description was given for the suspect, who reportedly fled the scene on a scooter-type vehicle with no lights.

Police were unable to locate the vehicle, however, and are asking anyone with information about the incident to call them at (413) 596-3837.

Ferguson shooting sparks outrage, shines spotlight on police killings

In a culture where the 24/7 news cycle dissects events and often fills the information void with opinion, the topic of police shootings has become polarizing — from the White House to cable shows to Asia.

LOS ANGELES — They were killed in Wisconsin, New York and California. Some were shot on the street. One was killed in a Wal-Mart. Another died after being placed in a chokehold. All died at the hands of police and all have been united by one thing: the killing of Michael Brown.

Details may differ, circumstances of their deaths may remain unknown, but the outrage that erupted after the Aug. 9 fatal shooting of the unarmed, black 18-year-old by a white officer in Ferguson, Missouri, has become a rallying cry in protests over police killings across the nation.

While there's been nothing approaching the violence seen in the St. Louis suburb, demonstrations fueled by a sense of injustice and buoyed with the help of social media have rolled across cities, regardless of whether the shootings took place last week or last month.

The spark, said Garrett Duncan, an associate professor of education and African-American studies at Washington University in St. Louis, was how Ferguson police bungled the aftermath of Brown's killing, leading to rioting and looting in the face of a heavily armed police force and, later, the National Guard.

"When you leave an 18-year-old boy's body in the street for four hours in a Missouri summer, that's going to trigger something," Duncan said. "The reason it's politicized is we still don't know what's going on. The boy is buried and we still don't know the circumstances."

"Folks exploit these things for one thing or another," he said. "Whether to loot — or get their 15 minutes of fame."

In a culture where the 24/7 news cycle dissects events and often fills the information void with opinion, the topic of police shootings has become polarizing — from the White House to cable shows to Asia.

Brown's name and Ferguson have become synonymous with police killings. They have been splashed on signs by protesters, added to hashtags on Twitter and referred to on T-shirts that sport the refrain heard in the city: "Hands up! Don't shoot."

In Albuquerque, New Mexico, a city facing federal-ordered reforms over excess police force, protesters have begun invoking Brown's name at rallies connected to the city's string of police shootings.

David Correia, a critic of city police, said protesters invoked Brown's name because they believe minorities have been targeted in some excessive force cases. Around half of the 41 police shootings involved Hispanic suspects in a city where about half of the residents are Latino.

"Although it is true that many of the victims of police shootings here have been the homeless and those struggling with mental illness, that element of racialized police violence is there," Correia said.

Brown's name has been spoken loudly in Los Angeles where demonstrators peacefully marched, held vigils and confronted police leaders over the Aug. 11 killing of Ezell Ford, a 25-year-old unarmed black man who family members said was mentally ill.

Police said he tackled an officer and reached for his gun. News media have reported that witnesses did not see any struggle.

With LA's long history of racial tensions between police and the black community — including the deadly violence that followed the acquittal of officers who beat Rodney King — the Los Angeles Police Department has taken a more proactive approach, releasing information and holding public forums.

"They've gone on a charm tour with the community," said Earl Ofari Hutchinson, president of the Los Angeles Urban Policy Roundtable. Still, he said, the same tensions that boiled over in Ferguson lie just beneath the surface in Los Angeles.

"While you didn't see the looting and mass demonstrations that you saw in Ferguson, the hostilities, distrust and mistrust between the African-American community and LAPD is still there," he said.

Brown's death has refocused attention on race in some killings or renewed interest in older cases.

The Aug. 5 shooting of a black man holding an air rifle in an Ohio Wal-Mart didn't become a racial issue until after Ferguson blew up with violence. The family of John Crawford III has since called on the U.S. Department of Justice to launch a civil rights probe.

In Milwaukee, demonstrators have taken to the streets three weeks in a row to call for federal officials to investigate police brutality against minorities after Dontre Hamilton, a 31-year-old black man who was shot and killed by a white Milwaukee police officer four months ago.

In New York, the City Council will review police procedures after a black man suspected of illegally selling cigarettes on the street died after being placed in a chokehold by a white officer.

Gina Thayne's nephew, Dillon Taylor, 20, was fatally shot by Salt Lake City police within days of Brown's death. Protesters decried the use of lethal force in Taylor's shooting and others, including Brown's, as well as the outfitting of officers around the nation with military-style gear.

Thayne said she participated in the demonstrations, but was reluctant to make a connection between the two cases.

"I just want to find out the truth, no matter what it is," she said.


Man killed when tractor overturns in Vermont

CABOT, VT. – A 70-year-old man was killed Friday when the tractor he was driving rolled over and trapped him underneath, according to Vermont State Police officials.

Robert Eastman, of 103 Jug Brook Road, was working on an area near his driveway when he lost control of his tractor on an embankment. It rolled over and down the embankment into a brook, police said.

Eastman was found pinned underneath the tractor at about 5 p.m. He was declared dead on the scene as a result of his injuries, police said.

Police have ruled his death an accident.

Cabot is located northeast of Montpellier.

Banh Mi Saigon opens its doors in Northampton 'in a much better place'

Banh Mi, destroyed last year by fire, is back in a new Northampton location.

NORTHAMPTON — A well-loved, family-owned Vietnamese restaurant burned out of its former location in Hadley is now up and running in downtown Northampton.

Banh Mi Saigon was one of a dozen small businesses destroyed in a massive Oct. 27 fire that consumed a rambling, wooden Route 9 Hadley strip mall. Friday, Bahn Mi reopened its doors at 181 Main St. in Northampton, the former site of Pho Vietnam.

On Sunday afternoon, owner Chuong Son, his wife Mung Pham, and other family members could be found working in the restaurant's downstairs kitchen. While some prepped vegetables for the venue's signature bahn mi sandwiches, pho soup, bun noodle bowls, rice plates and appetizers, others were cleaning and stocking after the day's lunch rush.

"The first day was a little hectic," said Son, taking a break. "We're getting used to the new place, and figuring out how to set things up so we can be most efficient. Simple things, such as where do you put certain utensils?"

At the time of the fire, Son didn't think he'd be able to rebuild. The family had poured its life savings into the venture. Thanks to generous contributions from individuals and the business community — and a loan from the non-profit community development group Common Capital — Banh Mi was able to rise again.

Son said he immigrated to the United States from Vietnam in 1989. In 2007, the woman who was soon to be his wife also arrived on American soil. "We were from the same village," said Pham. "We met each other at a wedding ceremony in Vietnam."

Northampton is a great place to be, said Son, with its bustling downtown.

"Maybe things happen for a reason," he mused. "Losing our business to fire was horrible, but now we are in a much better place."

Greenfield Police Tweet the day in the life of an officer

The Tweet-Along is a way to show people the duties of police and give residents a chance to ask questions.

GREENFIELD – Police are trying a new way to reach out to residents and give them a better idea of what the day in the life of an officer is all about.

At the start of the second shift on Sunday, Lt. William Gordon signed onto to the Greenfield Police Twitter account and started sending out messages describing the minute-by-minute duties of Officer Jason Haskins, a 7-year-veteran of the force.

“It is a new technology for us and we are trying to be a part of it,” he said.

Greenfield Police already has a Facebook Page where officers post a variety of information including arrest reports and public service announcements. The Department recently also started putting announcements out on Twitter.

The Tweet-Along started with the roll call, held every day at 2:50 p.m. before officers on the second shift hit the streets. It also showed the equipment used daily and a brief test of one of the Tasar guns, which is done before every shift. It is to end at 7 p.m.

During the feed, Gordon is posting photographs and information about what Haskins is doing. He is also following the scanner and including information about what other officers are also doing.

“It is a way to have another connection with our community. It is kind of a ride along people can do in the safety of their own homes and in the air conditioning,” Gordon said.

Gordon said so far his favorite part of the experiment is being able to answer questions from the public.

After showing a radar stop, one person asked if police have limitations on where they can use radar to catch speeders. The answer is they can go anywhere as long as it is a public way.

Another person wanted to know if the bulletproof vests officers wear are hot, especially on a day like humid day like Sunday. The answer is they are very heavy and on a warm day most officers have salt stains on their T-shirts when they take the vests off at the end of a shift. Greenfield Police are required to wear the vests, Gordon said.

“I can get information to people that they want to know. I can lecture all day but I’ve been a police officer for 20 years so my perception is different than someone’s who has never been in a cruiser,” he said.

Greenfield Police Chief Robert H. Haigh Jr. proposed rolling out the Tweet-Along on Sunday afternoon because it is typically a quieter shift. Gordon said he is relatively new to posting on Twitter so a slower-paced day gave him a chance to figure things out when there is less chaos.

People have the perception that police just drive around patrolling. This gives them a chance to see what officers do. Even on a quiet day they go from call-to-call, Gordon said.

Some of the incidents included in the posts are about deliveries of summons, traffic stops with a warning given, a $185 ticket for possession of marijuana, a minor car accident and a breaking-and-entering call. One of the calls he only Tweeted a small bit of information since the case is under investigation and some details have to stay confidential.

Gordon also mixed some humor into the blog. Before he rolled out the Tweet-Along, he posted a couple of video clips from 80s police shows CHiPS and Hill Street Blues. He also posted a photo of a Dunkin’ Donuts drink with the caption “must stay hydrated.”

He also posted some fun facts such as: Police never slam their doors to give them the element of stealth.

SPRINGFIELD — Police Commissioner John Barbieri last week declined an invitation from the Outer Belt Civic Association to discuss the city's latest homicide, which happened in the Outer Belt section of Sixteen Acres. But the commissioner has apparently accepted an invite to speak at an upcoming Exchange Club of Springfield event in downtown Springfield, according to that organization's leader.

Barbieri is the guest speaker at a Sept. 18 event at the 350 Grille on Worthington Street, according to Dot Lortie, chairwoman of the Exchange Club, an organization dedicated to promoting youth and community service and preventing child abuse.

Lortie said the public is invited to attend the noontime lunch event, which costs $15. Reservations can be made by calling (413) 783-0195.

Meanwhile, Barbieri cited the ongoing investigation into the Aug. 22 shooting death of 24-year-old Keith Gendreau as the reason for declining the invite from the Outer Belt Civic Association.

The association had sent a letter to Barbieri, asking him to keep them in the loop about crime prevention efforts in the normally quiet neighborhood in the wake of the killing – the city's tenth this year. But the commissioner said it was too early to elaborate on the investigation.

Walter Gould, president of the association, said he understood Barbieri's rationale, adding that the group didn't want to jeopardize the police investigation. "We are just trying to get information," he said, adding that Barbieri told him he may be able to attend the association's October meeting.


Chicopee police arrest 4 in connection with South Hadley car theft

A man called police after seeing his girlfriend's stolen car on Memorial Drive in Chicopee, police said.

CHICOPEE - Police arrested four men Sunday afternoon on Memorial Drive after they were spotted in a car that had been reported stolen in South Hadley, police said.

According to Chicopee police, they were called to the Hess Station on Memorial Drive just before 1 p.m. by a man who reported seeing his girlfriend’s car, which had been reported stolen, being driven along Memorial Drive.

Officer William Powell spotted the vehicle parked at the Auto Zone Plaza on Memorial Drive. He ordered the four occupants to get out and lie on the ground, and all four complied, police said.

When the car was confirmed to have been stolen, police arrested the four men, Brandon Jones, 19, of Vernon, Connecticut, Damahja Sharpe, 19, and Kourtney Johnson, 20, both from Boston, and Dante Lee, 18, of Springfield.

Each was charged with possession of stolen property, a motor vehicle.

They are scheduled to be arraigned on the charge Tuesday in Chicopee District Court.

CHICOPEE - Most of the 7,900 students in the city's public school will begin class on Tuesday.

There are exceptions, with students in grades 10 through 12 beginning the school year on Wednesday so freshmen will have one day of orientation while they are alone in the high schools.

2 dead in plane crash at New Hampshire airport

A witness said it appeared to be a normal takeoff until the plane's nose pitched up, causing it to lose speed and then crash.


NORTH HAMPTON, N.H. (AP) — A small plane attempting to take off from Hampton Airfield crashed into trees on Monday, killing the pilot and a passenger, emergency workers said.

The Cessna 180 with two people aboard came down alongside the runway at 10:50 a.m., the Federal Aviation Administration said. Both occupants were killed, Fire Chief Dennis Cote said.

It appeared to be a normal takeoff until the airplane’s nose pitched up, causing the plane to lose airspeed and lift before it rolled over and fell to the ground, said witness Bob Lamothe.

‘‘It was an amazing thing to see how quickly a plane can drop out of the sky,’’ he said.



The plane was not participating in the airfield’s Labor Day ‘‘flour bomb drop,’’ a competition going on at the same time in which participants pass over the runway and drop small sacks of flour over a target.

Lamothe, of Hampton, was part of a group that gathered at the Airfield Cafe in anticipation of the flour drop. Conditions were perfect, with good visibility, sunny skies and little wind, as they awaited the start of the event, he said.

The plane crashed about a football field’s length from the cafe, and many patrons ran to help. The plane’s cockpit was ‘‘completely crushed’’ by the impact and only the plane’s tail was intact, he said.

The Federal Aviation Administration, which was investigating the fatal crash, said the plane was registered to a Kingston, New Hampshire, man. No one answered calls Monday to phone numbers associated with him.

The National Transportation Safety Board will be tasked with determining the cause the crash.

Wine bottle sales slated at Forest Park farmers market in Springfied under first-ever city license

The weekly sale of wine bottles and small samples at Forest Park is allowed by the state and by vote of the Springfield License Commission.

SPRINGFIELD – The Farmers’ Market at Forest Park has added a new feature – the sale of wine from a regional winery – as approved recently by the state and the Springfield License Commission.

Mount Warner Vineyards of Hadley was granted Springfield’s first “farmer winery license,” that allows it to sell bottles of wine and give out samples of less than an ounce to potential buyers at the farmers’ market, said Peter L. Sygnatur, License Commission chairman.

Belle Rita Novak, manager of the Forest Park market, said the wine sales begin Tuesday at the weekly market. The market is every Tuesday from 12:30 to 6 p.m. from May through October at Forest Park in the Cyr Arena parking lot.

“I expect it will be well received,” Novak said of the winery participation in the market. “It’s all about helping to preserve agriculture in all of Massachusetts.”

Novak said she pursued the license on behalf of the farmers’ market, and that it may expand to a second regional winery.

“The only winery I want are ones that grow their own or buy local fruits,” Novak said. “Otherwise, it’s not a benefit to our agricultural industry in Massachusetts.”

The market moves indoors at the Forest Park monkey house in November, and then is offered every other week.

“It’s our 17th year for the farmers’ market and it just keeps getting better and better,” Novak said.

Sygnator said the license was approved by unanimous vote of the commission and is specific to the farmers’ market. The license granted is the first of its kind in Springfield, he said.

“This is a great opportunity for additional agriculture in the commonwealth,” he said.

The Massachusetts Department of Agriculture and Resources authorized the winery sales at farmers’ markets in 2010, Novak said. She believes there are several in Massachusetts

Hampden County district attorney candidate Shawn Allyn has come under criticism for his representation of the Carbone family. Now family member Patti Carbone is appearing in a campaign video for Allyn.

SPRINGFIELD — Hampden County district attorney candidate Shawn Allyn has come under criticism for his representation of the Carbone family. Now family member Patti Carbone is appearing in a campaign video for Allyn.

"Shawn Allyn has represented my family vigorously and honestly as our attorney," Carbone says in the video. "He is a man of conviction and integrity."

The criticism arose in March when District Court Judge Philip A. Contant issued a ruling about the relationships among Allyn, his client Dean Carbone Jr. and Carbone’s two children — all of whom Allyn has represented in parallel civil and criminal cases related to a fatal car accident on July 9, 2011, on East Mountain Road in Westfield.

Although he was not found to be impaired, speeding or texting while driving, Carbone, 40, of Springfield, was charged in District Court with motor-vehicle homicide after William Brown, the driver of the second car, died of his injuries. Carbone was not charged criminally until a year after the crash, but, in the meantime, a civil suit ensued, pitting the boys, then 7 and 10, against their father and Brown’s estate.

Allyn represented the children in the civil suit, which resulted in an out-of-court settlement Allyn said, paid out by Carbone’s insurance company and Brown’s estate.

Attorneys are ethically precluded from representing clients in cases with potentially opposing interests. Contant repeatedly wrote in his 25-page ruling that Allyn was “quite disingenuous” and concluded Allyn violated a slew of professional conduct standards.

Allyn said he never represented the children in the civil suit and their father in the criminal case simultaneously, despite the judge’s assertions to the contrary. In addition, Allyn said Contant brought his client into court months earlier and accepted a waiver of conflict-of-interest concerns by Carbone.

The criticism was raised again in an editorial last month by Mary Hurley, retired District Court judge and former Springfield mayor.

It was followed shortly was an editorial by Allyn who said, "It is abundantly clear that Judge Hurley did not review the facts of the case, the affidavits accompanying the motions and other relevant information prior to issuing her written editorial to the Republican/Masslive."

Before the month closed there was a response from Hurley who wrote, "It seems that Mr. Allyn is the one who needs to develop a relationship with the truth" as part of her second editorial.

In the short video, Patti Carbone says, "My family was recently thrown into the media spotlight to attack attorney Shawn Allyn. As a mother I was shocked to see our children used as political pawns."

Despite the attacks, Allyn "stood tall," says Carbone.

"Shawn Allyn looked out for my family," she concludes. "I know he will look out for yours."

Allyn is among four Democrats running for the position. The candidate who wins the Sept. 9 primary will be elected because there are no Republican candidates. The other candidates are attorney Hal Etkins, Assistant District Attorney Athony Gulluni, and former Assistant District Attorney Brett Vottero.
